Former CJ Rana's Brief Detention Triggers Outcry and Legal Questions

The brief detention and subsequent release of former Chief Justice Cholendra Shumsher JB Rana over the weekend has sparked sharp criticism from the legal fraternity and opposition lawmakers, with conflicting accounts emerging regarding why police took him into custody without formal charges.

Officers picked up Rana from his Maharajgunj residence in Kathmandu late Saturday night and released him to his family on Sunday afternoon after roughly 11 hours in detention. Following his release, Rana formally petitioned the Kathmandu Valley Police Office for additional security through an application submitted by his son, Sachindra, citing the security warnings raised by police when they detained him.

Contradictory explanations have surrounded the grounds for the police operation. Initial reporting by Nepal Watch stated that officers arrested Rana based on a complaint lodged with the Kathmandu Valley Crime Investigation Office, although authorities did not disclose the contents of the complaint. Conversely, My Republica reported that police arrived without an arrest warrant and held Rana on the pretext of a security threat from Gen Z demonstrators, claiming he needed to be moved to a police station for his personal safety. Police never filed charges against him.

Bar Association and Lawmakers React

The operation drew immediate protest from the Nepal Bar Association, which described detaining and freeing citizens without adequate legal justification as a direct violation of constitutional protections and the rule of law. In a statement issued on Monday, NBA General Secretary Kedar Prasad Koirala condemned arbitrary enforcement and expressed grave concern that officials barred representatives from the National Human Rights Commission from visiting Rana while in custody. The association also urged retired judges to maintain ethical conduct and refrain from commenting on or influencing sub judice court proceedings.

The incident also provoked heated debate in the federal parliament on Monday. Speaking in the House of Representatives, CPN-UML lawmaker Ain Mahar characterized the detention as an act of state terror carried out through abduction-style methods, according to My Republica. Mahar demanded to know why law enforcement detained the individual supposedly facing danger rather than identifying and prosecuting those allegedly posing the threat.

Rana assumed office as chief justice in January 2019 and was suspended in February 2022 after lawmakers registered an impeachment motion against him. Although parliament never endorsed the motion, he never returned to the bench before reaching mandatory retirement. He currently resides under a protection detail comprising five Armed Police Force personnel and two Nepal Police officers.
